Recently. the decision of the Ministry of transport on Amending the provisions on port operation and management (Decree No. 8. 2019 of the Ministry of transport of the people's Republic of China) has been publicly released. and has been put into effect since the date of promulgation.
The original regulations on port operation and management was issued by the Ministry of transport on November 6. 2009. In 2014 and 2016. two modifications have been made respectively. In 2018. the Ministry of transport revised the port operation and management regulations (hereinafter referred to as the regulations) for the third time. which came into effect on September 1. 2018.
Last year. the revision mainly implemented the general requirements of the state to deepen the reform of "deregulation service". simplified the scope of port operation license. improved the qualification conditions of port tugboat operation. and strengthened the supervision measures during and after the event. which is of great significance to standardize the market order of port operation and promote the high-quality development of port. In the revision. the requirements of relevant sub items of business license such as "container stacking. unpacking and simple processing of goods". "ship port service" and "port facilities and equipment and machinery leasing and maintenance" were cancelled. and the specific contents. conditions and procedures of the reserved port business license were detailed. In addition. the port tugboat business license conditions have been supplemented and improved. The port administrative department is also required to publish the record and good faith management to the society in a timely manner. and the port tug operators are required to publish the real-time status of the tugs they operate for the independent choice of the ship transport operators. so as to prevent the port tug operators from excluding and restricting competition and promote fair competition in the tugboat market.
